Whole Selves User Agreement

This User Agreement (the “Agreement”) is made effective as of date of subscription purchase (the “Effective Date”), by and between Whole Selves™ of Blue Nautilus LLC (the “Owner”) 107 North St, Granby, MA 01033 and subscriber (the “Recipient”).


All materials contained in the Whole Selves™ curriculum are copyrighted to and are solely owned by Owner. The Whole Selves™ curriculum includes but is not limited to the Whole Selves™ website, the Whole Selves™ program and lesson materials (the “Whole Selves Curriculum” or “Curriculum”). The subscription purchased and being made available to Recipient hereunder is designated for use by the named Recipient only. Transfer of Recipient’s account to another user is not permitted. Exceptions may be made only at the sole discretion of Owner.

Recipient hereby acknowledge and agrees with Owner:

  • That the Whole Selves Curriculum in its entirety is proprietary and copyrighted to Owner.
  • That Recipient is being given access to the Whole Selves Curriculum for the sole purpose of use within Recipient’s classroom, program, site, and with individual students.
  •  That Recipient is not authorized to train others on the Whole Selves Curriculum, share access to the Whole Selves Curriculum, or disseminate materials to other instructors, providers, or the public, in any fashion, or share access to the Whole Selves website beyond Recipient’s direct work with students and Recipient’s supervisor.
  • In no event shall Owner be liable for any direct, indirect, or special or consequential damages or any lost profits or lost savings in connection with or arising out of the performance or use of any portion of the Whole Selves Curriculum. Recipient further acknowledges and agrees that it is Recipient’s sole responsibility for compliance with Recipient’s appropriate licensing requirements, for the quality of instruction, or use and application of materials. Recipient shall not represent themselves as an expert, speak on behalf of Whole Selves™, its program or approach, or disseminate Owner’s materials without written authorization from Owner, which authorization may be denied or conditioned in Owner’s sole and absolute discretion.
  • That Recipient will have access to the Whole Selves Curriculum for the period of one year from the Effective Date. Recipient will need to renew Recipient’s subscription to the Whole Selves Curriculum each year.
  • The Whole Selves Curriculum is being delivered to Recipient "AS IS" and the Owner makes no warranty as to its use or performance.
  • Owner has the right to suspend Recipient’s access to the Whole Selves Curriculum for non-payment, or for failure to honor the terms of this Agreement.

Recipient agrees to protect the confidential material and information which may be disclosed between the Owner and the Recipient. The term “Confidential Information” means any information or material which is proprietary to the Owner, whether or not owned or developed by the Owner. The Recipient will hold the Confidential Information in confidence, whether during the term of this Agreement or after the termination hereof for any reason, and will not disclose to any person or entity (other than those authorized by Owner to receive or have access to) or use in any manner other than for its sole purpose, any of the Confidential Information without the prior written consent of the Owner, which the Owner shall be entitled to withhold in its sole discretion.
